pain & suffering for a child

My 2 sons were with me when I was in a car accident. The accident was not my fault. I was stopped at a light when another car hit me which made me hit the car in front of me. My one son was fine but my younger son who is 5 & myself were taken by ambulance to the hospital. He was complaining his back & head hurt. The doctors checked him out & sent him home. No further action was taken but to give him ibuprofen for any pain. now i am closing out his claim with the insurance company. they agreed to pay his medical costs. My question is, is he allowed a pain & suffering compensation. they said they would give me an extra $200 for that. Does anyone think that is reasonable? For about a month he would get up in the middle of the night screaming because of bad dreams, & he would not get into a car without forcing him because he was afraid that he would get into another accident. If not what is usual & customary to ask for?

GET AN ATTORNEY AND SUE THAT INSURANCE COMPANY!!!! I was in a car accident 3 years ago and was injured. The ins co only wanted to settle w/me for only $500. I got an atty and ended up getting $45,000!!!!!!!! Trust me, DO NOT settle w/that insurance company! Even if you can't afford an atty, threaten that ins company that you do! And trust me, you'll get a LOT further! Good Luck!!

First of all, don't close out any claim with any insurance company. If your own insurance is not adequately compensating you then you should have an attorney subjugate against the other driver's insurance for additional damages. meanwhile, don't agree to closing out anything or saying or doing anything which implies that you're satisfied with the compensation you received thus far.
