No insurance

Someone cut me off on the freeway and I crashed on my bike. The CHP reports states that the woman admitted to being in the wrong as well as testimony from other witnesses that she was at fault. I don't know how messed up my bike is because I was witnesses and was taken to the hospital. I have some injuries and I am now missing work. But here is where I'm totally lost. I don't have insurance, what can I do?

I was in a similar situation a long time ago. Someone hit my car with their car. Totaled my car. I called their insurance company. Once they found out I didn't have insurance, they wouldn't even talk to me.

I filed a personal lawsuit against them and got the money that I needed. But, it was under $5,000. That was the monetary limit for which I could sue someone for small claims where I lived. You may be able to file for more money where you live.

My point is, that you should be able to get some money by going to small claims.

Another thing that you might want to consider, is going to an attorney and at least having a free initial consultation in order to get some answers.

If the police report states that it wasn't your fault, it should be her insurance that covers it. If not, it sounds like you have a really good tort case.

I do agree with the answer above. I did forget to mention in my other post that the police did not determine anyone to be at fault because the accident involved ice and snow.

I would get copies of the police report and present it to her insurance company.

Forget about your not having insurance (for the time being). You have the CHP report that lists the other driver as being at fault. So you send the report with copies of your medical bills to her insurance company. Then see what happens.

And get insurance for the future.

Yes, That is the reason that people have insurance. To protect themselves from paying out of pocket when they mess up. You are not at fault. Take ScottGem's advice.
