I've heard that in order for a person with dementia to sign a legal document it has to be shown that at the time of signing the document, the person has to be aware of what they are signing and what it means. I have forgotten what law covers this type of situation. Could someone please advise me???
Background on this request deals with a woman on medicaid signed her property over to her son, (who also has durable power of attorney), and the state (Oregon) wants the property transferred back to her, reason being is she was unaware of what she was signing due to dementia.
