law regarding bringing kids from India

Hi! This question is regarding my brother. About 15 days ago my brother and his family went to India for vacation. My brother and his wife have Green Card and their children aged 7 and 2 are US citizens. 5 days ago, While visiting his in-law's house, my brother and his wife had an argument. After the argument, my brother's wife went away from the house and never contacted my brother and his children. My brother and his children pleaded my brother's in-laws to show her but they are not allowing him to contact her. We all are shocked by this irresposible mother who can leave her kids like that. My question is can my brother bring his children to USA. He is the one who is caring for this children. Before coming does he need to file any police report in India. He has not filed any police report till now. What should he do now. A happy vacation has turned into a nightmare for my brother's family. ---Thanks

File a police report for what?

The kids are US citizens and they reside in the USA. He is well within his rights to bring the children home to the USA.

There is nothing to file a police report over.

Perhaps the American embassy/consulate in India may be of assistance.

NeedKarma is 100 percent correct, if you are in another nation and run "afoul" of a situation, the American emassy can often give you guidance and help you though various rules.

But unless the law in India gives the mother certain rights, but the children as US citizens have specific rights as such also.
