    How do I collect money owed to me?
    I sold a new printer to a friend he now refuses to pay me for it he says that my husband owes him money so he is taking the printer for his payment.
    He had asked my husband to take him fishing because he has no drivers license, my husband said he would as long as he would pay for the fuel, now he says that he owes him for the fuel and he is taking the printer for payment.
    I am trying to run a photo business and I need the money to replace my printer. What do I do?

    Sue him in small claims court. You'll say you sold him the printer; he'll say you owed him money and gave him the printer as payment. The judge will believe one of you over the other - there's no guarantee it will go in your favor but that's your only option.

    If you win, collecting is always the hardest part.

    You probably won't be able to get anything if you don't have it in writing. Plus, it cost money to file paper work with the court. Very slim chance of winning. Next time get the money before you let a person walk off on faith. Being smart about that kind of thing is better than being nice.

    You can sue in small claims court. He's not saying you didn't sell it to him, he's saying he's not paying you because your husband owes him money. No court is going to buy that as a defense. Don't tell him that, let him answer with that.

    You can sue for the agreed upon price of the printer and your court costs. If he has a beef with hubby, he has to sue him.

    You go to Small Claims Court - costs pennies on the dollar to file. You argue an oral agreement; the other party argues there was no oral agreement (or whatever his defense may be); the Judge believes one of you.

    I'm in NY and oral agreements which make sense to the Judge "stand" all the time.
