    Holding company property
    I am leaving a company that owes me a great deal in commissions. I will never see most of the commissions if any at all. I have a company laptop that I am considering keeping until I get all of my commissions. What are my rights where this is concerned? What could happen to me legally if I refuse to turn in the laptop until I receive all of my salary and commission. I work for a very corrupt and ruthless company that exploits its workers and has taken away all employee benefits. I could not longer be associated with such a business. The business is located in Virginia.

    I'm not too sure holding company property for ransom is the right thing to do. If you have proof that pay is legitimately due, you should file in small claims court.

    Two wrongs don't make a right.

    They can charge you with theft. That's not going to help get you your money. CaptainRich is right, sue 'em!

    Yes if you do not return company property, they will change you with theft of that property. If you have proof they owe you money, what you have to do is sue them in court for the money they owe you.

    Thank you for your responses. I will not keep the company laptop. I do however, have a copy of all of my orders that I have sold to prove they owe me $7,750.00 in commissions. Is that enough to take to small claims court? Do I Have to hire an attorney to do that?

    Hello again, rocker:

    It's probably $2,200 MORE than you can get in small claims. But you don't need (aren't allowed to have) a lawyer, and it's quick, cheap and easy.
