    Hipaa violation at Pharamcy
    Can a patient pick up a prescription after the Pharmacy is closed given that the rest of the store is still open?
    Can a person say a patients name via intercom? Such as: "John Smith, your prescription is ready"?

    If the pharmacy is closed, I would say that you can't pick up the prescription. But that's just a guess on my part.

    And if you have dropped off a prescription, and are shopping in the store, I don't think that it's a violation of HIPAA to announce that your prescription is ready. For one thing, it is highly unlikely that someone is going to race over to see who John Smith is. For a second, it's possible that John Smith is picking up the prescription for someone else (wife, kid, etc.), so you haven't really learned any health information.

    But this is not my area of expertise, and I could be wrong.

    Pharmacy closed... No prescription drugs.

    HIPPA deals with passing specific information (either deliberately or unintentionally) about your health status or case history to a person who has no "need to know" without your permission.

    As I stated on another thread about HIPPA I have just completed a HIPPA Refresher because of my Volunteer position with a hospital.

    As previously stated you cannot receive a prescription from a closed pharmacy. It is not really hippa laws that dictate this but federal law stating that only a licensed pharmacist can fill a prescription. One must be at the pharmacy at all times prescription medications are being dispensed. He/she does not have to be the one to hand the prescription over however if the patient has any questions the pharmacist must be available. As for stating name over loud speaker... this is not really divulging any info as it could be anyone's prescription or could be given for a wide variety of reasons. Cathy
