    Florida eviction questions
    I live in Polk County Florida .
    I am wanting to evict my 19 yr. old son from my home .He has lived here all his life. It may seem cruel and I am very heart broken over this but there are various reasons for my decision,. He's very destructive and becomes violent (without bodily harm).

    I have had to call a Deputy out 6 times in the last year and refuse to put up with his behavior any longer.

    All of the Deputies have told me the same thing about evicting him.
    I will be going to the Court House tomorrow and want to know what to expect .
    My son has never had a Job and will not look for for .

    How hard will it be and what steps will I have to go through to have him evicted?
    I was told by Deputies that they will serve him within a day(because he is nonpaying) . Does this mean he will be escorted off my property the day the Deputy serves him.

    Any advice or facts will be greatly appreciated .

    You are required to give him a written 30 day notice.

    After 30 days if he has not moved, you go to court and file for an eviction.

    They come out and serve him notice, of a court hearing, you appear in court and then the court will give him a date he has to be out, If he is not out on that date, then they come and escort him off the property

    Believe it or not the law considers himyour tenant, so you must follow the full and complete FA laws. Florida Evictions

    Thanks for your answers . I do appreciate the time you two took to respond however, ALL of the officers who came out told me that BECAUSE my son wasn't a paying tenent that the courts would issue the eviction within the same day that I filed with the courts.
    And that an officer would serve him within a day and whenever an officer became available. I'm just wondering if this is true... I WAS TOLD THIS YESTERDAY JAN. 30'th 2010
    And also how much will be my cost to file the papers and have him served? I'm not asking for any rent collected at this point . I just need him evicted.
    I have done some research and find info on all types of evictions but can't find any on None Paying tenents. I shall keep looking.

    What an officer does or says doesn't insure its 100% legal. Police can make mistakes, break the law and maybe even lie just like the rest of us. Any person living in your home, paying rent or not, is a resident. He must be evicted. Please tell us how this plays out as you move forward.
