I owed money with my ex-husband to a don't pay a cent event on furniture. During our marriage he received letters from the finance company saying that he was pre approved for various amounts of money. He went in to the company and took these loans out on our original loan behind my back. I had paid off the original loan. When I left him I went to the company and asked to be given a loan for half the amount as to pay off half of what was owed and they said no. That was in September 2000. He filed bankruptcy last year. I have not had any contact with the company since 2000. Do I still owe them? I also have student loans and am wondering if there is a statute for that as well. I live in Ontario.

If your husband paid off a joint loan with a loan in his name alone, you ceased to be responsible for the original loan as it is now his loan. Any subsequent loans are his loans. If he filed , no one should be calling you. Otherwise, the SOL in Ontario for a debt incurred in 2000 is 6 years. No SOL for Ontario Student Loans. Six year SOL on federal student loans with may exceptions. Read Canada Student Loans Act and Canada Student Financial Assistance Act for exceptions. What ever you do no not initiate contact with Federal student loan creditors as that could be deemed to be an acknowledgment of the debt
