credit card debt of indigent user

my daughter got herself into credit card debt and cannot pay any of it off, she is on social securit disability, does not own anything, does not drive, does not have a bank account and has learning disabilities and is 47 years old. she gets $610 per month which pays for her rent, medical etc., she has now been served by one of the credit card companies and has to file an answer with the courts, i don't know anything about this kind of problem, i am also disabled and on social security and cannot help her financilly any help and advise would be greatly appreciated.

Of course the issue of how and why she got a card to start with,

But they will try to get a judgement, and will try to get any money she may have in a checking account.

She needs to take proof of everything you have just said to court when they have the hearing

Hi Tiderc,
Legally, they shouldn't be able to garnish her disability payments. So technically, the credit card companies likely have little recourse at this time. They can likely take her to court, and perhaps receive some sort a judgement pending any future employment. Though any money they were to receive at this point, would likely have to be strictly voluntary on her part.
Being on disability would as well qualify her for free legal counsel. Perhaps it would be to your benefit to talk with your local legal aid office. Generally, they will have a number in the front of the phone book. If not, the Social Security office should be able to refer you.
