Collection agency has sent letter for a debt, but pursuant to WV code the statue of limitations has expired since last contact. Can the collecection agency coleect the debt with all late fees, over the limit fees and interest?
If the SOL has expired, then that simply means they cannot sue you to collect the debt. It does not mean they can't continue to dun you for what they say you owe.
Yes they can send you collection letters if they want til the day you die, SOL does not mean you don't owe the money , it only means as scott noted that they can no longer sue you in court
And of course some of the "firms" may try and sue you hoping you don't notice the SOL or will try to get a judgement by not properly notifing you,
