co-owners in disagreement

When my father died he left his house to myself and his girlfriend. She lives in the house and she is the only one on the morgage which she is in default on. I want her to sell the house and she refuses. I am worried about the bank taking the house. Can this happen? What can I do leagally to get her to sell it?

You can file a lawsuit to force a partition of the property. In a partition the judge orders that the property be sold and the proceeds be equally divided. Since there is a mortgage on the property that needs to be paid off, and since you are not responsible for the mortgage, things are going to get a little complicated. I strongly recommend that you have an attorney handle this for you. Good luck!
