    Can you be fired for being sick
    Is a Employer within their rights? Can you be fired for being sick? My employer claims If he does not receive a doctor's excuse for one day off sick on which is an unpaid day, that I will be fired. Is he with in his legal labor law rights? From Williamsport Pennsylvania

    Your company will have a sick policey in your contract

    Some contracts do state a sick notes is required for as little a one day

    Do you have a contract? How long have you worked there?

    Yes, if that is company policy they may do that. Agreed it is normally for probationary employees but companies I worked with often required that during the first 90 days.

    Is there a reason they believe you were not ill ?

    Do they require that of all employees ?

    Thanks Two both answers. This is my wife she works for the school district as a cafeteria worker. She has a union, but I don't know exactly what is written as of yet. I wanted to know the laws outside the union policy. She has worded for them for over 2 years and this is not a habit. The trouble is she had put in a written unpaid day off and actually became ill on that day. Her request was never answered either way. She truly became sick ironically.

    Union policy prevails unless it is contrary to law. If the State does not require (and I'm sure it doesn't) a note for sick days but the Union and/or employer do - she needs to provide a "sick" note.
