Can a debt collector change the account opened date?
I have an unpaid debt that was derogatory in 2007. The debt was purchased from another debt collector in March 2011. The original creditor is no longer on my credit profile but this new debt collector shows the account was opened in March 2011 and reported in April 2011. To me that sounds they are not reporting this correctly. When in fact the original account was opened in November 2006 but went derogartory in 2007. Shouldn't they report this as the original date the account was opened or went derogatory? As far as the SOL goes this wouldn't expire till March 2021 and wouldn't be off my credit till March 2018! Is this legal?

The open date doesn't determine when the SOL clock expires... its the last date of activity that starts the clock. Activity doesn't necessarily mean the date the debt occurred.

Certain acts can be considered activity. Payments, agreements, certain court filings can be that activity. I'll let someone better versed in the details give more specific answers.

The date of the debt in this case would be probably sometime in 2007 when you "officially" stopped paying them. That would make the SOL of 7 years 2014. There should be a correct date when you originally opened the account in Nov 2006 listed as Nov 2006 and not the date when the account was sold to the other firm.

Have you paid them anything since 2007 or agreed in writing to pay them? If not, then the original SOL dates given above stand.

Your post is somewhat confusing, but this is my best guess: You opened a credit card in 2005 and defaulted on the payments. The credit card company sold the debt to a collection agency, probably in 2008, so the agency is listing their open date as 2008. You want to know if this is legal......
