    Being sued when account is charged off
    Hi I was served today with papers I have a loan for a surgery that was charged off on my credit in 02/2007 and now I am being sued is that legal? Or what can I do thanks:eek:

    Charge off is more of an accounting term or taxable event; the suit is to make you pay a past due bill.

    Sure they can.

    The term charge off is for the financial records of the company and has nothing to do with the fact that you owe the money.

    Even after they charge it off, most businesses will sell the charged off debt to a collection agency for about 50%. Then, as long as the debt has been legally transferred, the collection agency now owns your debt and they can take what ever means necessary, as long as they follow the laws, to collect this debt.

    You can try to offer a settlement and payment plan prior to going to court, or, you can show up and present your defense as to why you have not paid it.
