    Apartment Lease
    I lived in a house that was mold infested and I got sick behind it. So Me and My family had to move quickly to an apartment that was small. I have 2 boys and 1 girl. The apartment is 2 bedroom my daughter has to sleep in the room with me and my husband. I have found another apartment that is three bedroom and I applied for it, they contacted my new landlord and now she does not want to let me out of the lease and she has told me that I would have to wait 6 months to get a 3 bedroom. I need to know what are my rights in Mississippi Lease Law.

    Check the sticky notes at the top of this forum for links to local laws. But generally, if you have a lease in effect, the landlord can hold you to it. You can try subletting if the lease allows or try to find a replacement tenant.

    Obviously you have a lease that is a legal agreement and is binding. Another direction you may want to try is to call city hall and find out what the guidelines are as far as per square foot of living space required. Five people in this particular apartment may be beyond the code and you would be able to get out of the lease that way. Be sure to ask what rooms are not counted towards the footage and be sure to take inside measurements. An example in our area: Living space does not include the kitchen, bath, hallways or closets... we need 150 sq. ft per adult and 100sq. Ft per child.
