Can he take the land by building on it for 7 years?

This is the deal. My mother has 3 brothers and 5 sisters. My grandad left 2 1/2 acres to each. My grandmother has 2 1/2 also. everything is on the family estate. already divided up. My mom and one of the aunts take care of the taxes and oversee one of the brothers portion becasue he is in a mental institution. The other uncle is living on the land and has allowed his children to start building some type of business on the brother who is instatutionalized property. He plans on making it into some type of farm. He has given some of his property to his children but he has 3 others that he is trying t leave land to. I do not think they have a clue what is going on.

THis is back woods Georgia where you can pretty much build anthing on your land and other people land. Can he do this? We find out he has been going up to the mental institution over the years. WE do not know if he got my uncle to sign something over to him. My mom is the oldest and she is very business like. they do not get along because.. she always says no to his schemes. He got my grandmother to sign her only home over to him so he could give her a better life and also....the logic was if she has to go to a nursing home, there would be no problem. He took out a second mortage on her home. well it is his now. HE used the proceeds to build on the other brother's land and to jump start his private investigation business. My grand dad before he died did not want this to happen but my grandmother did it anyway. Now she wants her home back in her name.

Well.... I think he should give it back for $1. HE expects the rest of the sisters and brothers to buy him out if they want grandma to have her house back. He is very strange. Vietnam vet. married lots of times. does not have anything except for the 2/12 piece of property. He keeps a girl friend..but it is always someone who has some influence ..not much family and has some assets. He is a smooth talker. always got some money scheme. He travels the world. I think he is a bounty hunter. I am concern because my my mother tells my brother and I her land is ours. she will not build anything on it. SO she lets us make decisions about it.

Eveyone of the brothers and sisters got paid 1800 to get the trees cut down off their property except my mother. She wanted to see a contract. read things over. Well...they went on and got it done. When we all went to see. it... it looked a mess. no shade just trees everywhere. they got the good wood and left the old stuff. Now they have to pay 3000 each to get it cleared off!!. My brother an I pleaded to mom not to cut down the trees. We want some buffer for privacy ad shade when we build and did not want to get rid of all the wild life. She did not get her 's cut. THe area is so beautiful.

Well. can he build and live on the property and use it like it is his? he restored the family home on this property but it is on the edge of some of the other brothers and sisters. WHat legal rights do the sisters and brothers have if grandma does not have a will? THis seems so wrong. what are your gut feelings on this scenario. Can he do this. SHould his children stop building.

The land is not clear and it is not even his. HE should only be using his own property and not my other uncle's land. If my mom is paying the taxes on it...shouldnot she have some legal right to it? If land is in forclosure, all it takes is for someone to pay the taxes on it and it is theirs. Is she just paying for my uncle and he can still give it away with her knowing it? SHe is just trying to keep it in the family.

What do you think about this?

First one person can not make any contracts for anything on anothers property. ( trees) so no one can cut trees on your property unless you agree. If they do, they tresspass and have to pay you for all the damages.

Next if a person takes possession of property and keeps it for a certain amount of time, yes at times they can take it. But since it is know, who is the guardian for this person in the mental institution, since only the guardian can do anything about it.

Next gradma can't lose her home unless she signed it over,

Alot of things you mentioned could not have happened without alot of papers being signed, so you need an attorney.

If this happens to be around the SE part of GA perhaps around the Waycross or Baxley area, I know a good attorney there

My Grandmother Did Sign Over The House To My Uncle With Out The Other Children Knowing. Now She Wants It Back. He Is Willing To Give It Back But Wants A Cut..all The Money He Has Invested In It. He Did Not Keep Up With The Taxes And My Mother Had To Pay The Taxes On The House That Is In His Name Because It Was Delinquent. The Other Sisters And Brothers Pitched In To Help Also, So Mom Got Her Money Back. Everyone Is So Upset But He Is Family And We Love Him.........there Is Always One In The Family That Just Will Not Be A Team Player And Out For Self. At The Last Family Meeting They Said They Would Get A Lawyer To See About Getting Grandma's House Back.
Thanks..will Keep You Posted How This Goes.
