    Names on Deed not Mortgage can they come after me?
    When my husband and I bought our house I didn't work so they only wanted to put the mortgage in his name. They put my name on the deed and not the mortgage. The house is in the state of Pennsylvania. Now we are in preforeclosure and the letters are coming in my name. Can they come after me if the mortgage is not in my name? Thanks for any help any one can give.

    If you didn't sign the promissory note then they can't come after you for repayment of the loan but they can still foreclose on the house.

    Thank you so much for your help and very fast response. I'm not sure if I signed a promissory note. If it was with the mortgage papers then I would have to say no. But the mortgage company just told me that because I signed the deed they can come after me for the mortgage.

    Why did you sign the deed? Deeds do not require signatures by the buyers except in certain condominiums where the buyer is agreeing to be bound by the condo association rules and regs.

    You need to be absolutely sure that you did not sign the promissory note. Take out your copy of the documents and look them over carefully. If you signed anything that says Note or Mortgage Note then the lender can come after you for repayment of the loan.

    I will look at them right now. I signed what our attorney said to. Young and dumb should not sign papers.

    MY husband took out the house loan its totally in his name only... BUT my name is on the deed... IF the loan is in his name why is the House mortgage on my credit report.. I signed nothing for the loan...
