    NowWhat, OOOHHH that explains a lot! I thought I had to be summoned to court, then show up, then give a plea or no contest, then work from there, but I thought the only way they can come and arrest me is if I did not show up to court, then I would have a warrant, but guess I thought wrong. That's cleared up a lot. Thanks!! :)

    Well, I have never been in trouble and I am sure some one here will correct me if I am wrong. But, I would think getting arrested i.e. formally charged would be the first step.
    Until that happens - relax. Do what you said you would do - pay for what you have taken.
    I would still get prepared for what could happen next. Start interviewing attorneys. Most offer a free consultation. Find out what their retainer fee is and start saving some money. You don't want to be blind sided and make a rush decision.

    Ahh now I see. At this point all you can do is wait it out. If they decide to press charges rather than let you pay back, then they will have to swear out an arrest warrant. At that point the police will come arrest you. That's when you can get an atty.

    OMG are you serious?? :( Will I have to stay in jail until I go to court? Or until I get sentenced? I don't get summoned to court or anything?

    Wouldn't I have been arrested already though if they had pressed charges? I knowthey are not getting the evidence together because it already is since we gave them everything back and they took pictures of it and we wrote our letters and they had calculated all of it... so I would've been arrested already right?? I mean it was a month ago!! Also I recently posted that my mother in law had a secretary in her business that embezzled over $100,000.00 and was caught a little over a year ago and she hasn't been arrested yet?? OMG I am so confused and back to being scared!

    Please see an attorney as soon as possible. If someone does press charges and then you are to be arrested, then since you do not pose a flight risk (running away from the situation) then in a case like that all you would have to do (because your attorney would have intervened on your behalf) is show up at the courthouse, your attorney may have already spoken with both the judge and the prosecuting attorney, and you go to the jail, become formally arrested go through the process, and just walk out and go about your business and wait for your court date. You have to plead not guilty if you want things to be continued so that your attorney will have time to gather all of the necessary information and do the plea agreement thing. When everything is worked out by the attorneys, then you plead guilty, a pre-sentence investigation is launched (if you choose to have one), and you wait until the date you are to be sentenced.

    Also, it would be to your benefit to stop all the asking all the questions online. You are on information overload! You have received some really good answers to your questions and have spent many hours on the Internet. Call an attorney first thing tomorrow! Please take a break! Truly, I believe you are not in any danger, or they would have arrested you by now.

    So what if I don't get an attorney beacause honestly I really have no case. This is based on assumption, I don't know if I am getting charges against me or not, but I have a strong feeling I will get charges against me. Would attorneys want to work with me? I mean I don't want ot pay for an attorney and then nothing happens? Or should I just consult an attorney let them know what is going on, and then hire that attorney when it happens? So when/if I get arrested they take me in and then I don't have to put bail?? God I am so scared... The world is out to get me...

    An attorney will work with and for you. They like their money! Prep the attorney with a free consultation and hire later, if needed.

    :D yeah trying! I figure you're right, I more than likely would be arrested by now... so no worries. Thinking of the good stuff... I'm planning a trip to Disneyland with my family and fiancés family (childish I know but I love Disneyland)

    It wouldn't hurt to consult with an attorney, but frankly I don't think its necessary at this point.

    It is unlikely you will do jail time, even if convicted. If you are arrested (and I don't think that likely at this point), you would probably be released or given low bail.

    One thing I WOULD do is start putting money away. Set up a savings account and put money into it so if they do ask you start reimbursing them you have the money to do so.
