    Common law
    If I was only married 1 time legally then moved in with someone else for five years had a child together but never got married than would it de considered marriage and would I have 2 get a legal divorce even though we don't live together.

    Depends on where you lived.. some states it (common law marriage ) happens after 7 years of cohabitation (like Virginia)... others more or less.
