I was terminated from my position with a large corporation while out on disabilty.
I don't qualify for FMLA but another employee in my same position was allowed to return to his job after 3 1/2 months, I could have returned in 5 weeks.
Do I have a course of action />????

Likely not......they aren't required to hold your position open forever...and what happened with one person isn't the exact same as yours is.

WIthout a contract you are at-will, if you are at-will, you are their at their will....as well as your own...if both sides don't want you to be there...then you won't be there.

You can hire a lawyer...spend a year or more fighting, and still lose. And even then...if you managed to win that....you would be under the microscope and they would find a reason to get rid of you or make you want to quit.
