My husband was wrongly a accused of a sexual crime and served 3 yrs in prison for it.He was set up by his ex-wife. His cousin was the one who committed the crime and they had his and my husband records combined in one. Because they both had the same name but different middle names that start with an A. The judge wouldnt listen to his lawyer. That the people in the report were different people. So my husband ended up serving 3 yrs for a crime that his cousin commited.He has been out now for 2.5 yrs but has to register until 2012. before his name can be cleared.
What I am asking how can he find and get a good paying job with benifits.With this against him. He has a job now that his step-father got him(by pulling some strings) thru the company he works at but he doesnt have any type of benifits what so ever.We have been looking for another job for him that has benifits for him thru the job for himself and me and my 17 yr old son. But it so hard trying to find him a job that dont discriminate against him because of his background.

You'll excuse me, but I have to wonder here. Judges don't listen to lawyers, Judges look at EVIDENCE. Now a sexual crime usually involves some sort of DNA evidence. I also have to wonder how this cousin "combined" the records.

I know this doesn't answer your question, but my feeling is that, if your story is true and your husband was framed, then he stands a better chance of fighting the conviction and getting the record changed, maybe suing the parties involved.

Have you considered getting a position that offers benefits? A friend of mine gets his health insurance and dental through his wife because she works in a larger company that has better benefits than he can get at the small office where he works.

To answer your Question his cousin already had a sexual case pending on him and when the charges were brung up agaisnt my husband (now) the files all got combined into one.There where no DNA test taken because it involved a child molastation charge.His mom and step-dad did everything they could it cost them a pretty big chuck of change(if you get my meaning) But nothing worked .They even requisted another Judge but they couldnt get one at the time. So the real child molestor walked away free (and is still out there)while my husband spent 3 yrs behind bars for something he didnt do.

You see I have a son 17 and a daughter 15 (not his children mine from previous marriage)nd the law doesnt have a problem with him and I being married and the children under the age of 18.

I've heard of miscarriages of justice, but this just seems to go beyond that. I'm sorry, but I just don't buy it. Any competent lawyer should have been able to prove that there were two different people.

I just noticed that you married this guy 3 months ago. So you really don't know what happened 5 years ago when this incident occured, do you? This makes me even more skeptical of his protestations of innocence.

That would be great If i was able to work.But my medical conditions stop me from getting a job.I have COPD, bylaterial corpual tunnel syndrom in both arms that I have to wear braces all the time (which isnt fun) Its is hard to do anything with them on even type this message to you)except to take a bath and bed plus 2 bulging disk in my lower back and 1 in neck. I have been fighting Social Security now for going on 5 yrs and still havent gotten approved.

So that is why my husband of 3 mths is trying to get a better job with benifits to help take care of his family.

That is true if the lawyer my husband had and the one my mother in law and father in law hired at the time were not related to his ex-wife.Without them knowing it . The lawyer was getting his pocket lined from both ends of the candle stick if you know what I mean. But the good news is that the candle stick finally burnt out and he lost his lawyers licensse but that wasnt until after my husband had served those 3 yrs.

And that just reinforces what I said that he is better off trying to clear his name. If you can prove that his lawyer had a conflict of interest due to his relationship with the ex-wife, then you should be able to get the verdict overturned. That's almost a rubber stamp.

Thank You Scott for all the talk we have had. I talked to his mom last night and the 2 of us are going to try to see what we can get done to clear my husbands name and to put the right person behind bars for what he did. But one step at a time and one day at a time.

Good Luck and keep us posted. If what you told us is true, I think you stand a good chance of, at least, getting the verdict overturned. This may or may not lead to a new trial where he can present a more vigorous defense. You should also be contemplating a civil suit for false imprisonment.
