    What happens if you rear end a car and the other driver has no licence?
    I was on the freeway and the car in front of me slams on his breaks and I rear ended him. The driver was borrowing a car with insurance but the driver had no license. I have uninsured motorist insurance and liability. Will my insurance go up if I claim it or is the owner of the other car responsible for letting a unlicensed person drive his car? This happened in California.

    The driver in front of you gets a ticket for not having a driving license, That has no bearing on the accident or who is at fault.

    You are at fault for hitting the other car in the real, Your insurance will have to pay for his damages and for your damages if you have full coverage on your car.

    I second what Fr_Chuck just said. You are ALWAYS responsible for maintaining a safe distance to the car in front of you.. and if you fail to and hit them.. its your fault.

    If your insurance goes up or not depends on your age.. your driving record and low long you have been insured without a claim... AND which company you have.
