car insurance co. stall 2years, uncle dead

My uncle bought a handicap conversion van Jan.. 2007 . Paid with check from only savings. $43,000. Gave the owner of co. a check. The man left the van with not one piece of paper. Said he would bring paperwork back later. Van had hand controls. Uncle had not driven this van or used hand controls before. Uncle had partial paralyzed left arm. The hand controls were located on the left side of the steering column. They removed the driver seat for him to drive his hoverround power chair in to drive. The tech that was with the owner kept saying he wasn't comfortable with leaving the van with my uncle. The insurance co. covered the van. Two days later my uncle wrecked the van and was killed. was covered by his insurance co. Insurance co. insisted the van could be fixed. Once the frame had been compromised it should have been totaled. A dealership had the van for almost a year. The insurance co. kept backing them on everthing they did to the van. They only made everything worse much less the loss of usage for my aunt who needed the van for transportation to dialysis. She has had to have ems transport for 2 years now

Sounds like you need to get an attorney to get the insurance carrier to come through.

ladymac agrees: We've had an attorney since December '07. He 's dragging too.

Too late now but if you carry car replacement (rental) insurance the insurance company works very quickly because they don't want to pay for that replacement car for a long time.

No rental car insurance? Your inconvenience doesn't cost them a cent!

When I met my husband he didn't carry replacement insurance, was in a bad accident - and it took 5 months for the company to settle. Meanwhile, he had to go out and buy another car. The insurance company argued repair and the collision shop argued totaled and it went on and on and on.

Then he added rental coverage.

Keep after the attorney to do his job. Keep calling his office. You deserve answers on this and some attorneys are slower than molasses sometimes.
