UK Tier1 dependent visa rejected

Hi,

I am currently on Tier 1 General visa and have been staying in the UK for the last 3 years. I want my wife to join me in the UK.

She applied for her Tier1 general dependent visa in Sept09 from India and British High Commission rejected because of low maintainence funds. It was surprising as I sponsored her and gave 3 different bank/building society statements for the last 6 months with good enough balance. It seems that the Visa officer made a mistake and only looked at 1 statement and that too the one with lowest balance.

There was no provision of making an appeal. My wife then applied for tourist visa so that she could visit me for few months, go back to India and re-apply for dependent visa. Now, this time her tourist visa also got rejected as Visa officer is not satisfied that she intends to go back to India before expiry of tourist visa. This time she is given an appeal form along with the rejection letter.

I am not sure what is the best option for me at this stage. Since her visa has been rejected twice in the last one month, I am really cautious about the next step. Should I make an appeal or make a fresh application for dependent visa or is there any other option?

Could anybody please advice?

Sorry to hear that .. but I would like to know that Did she prepare any case before applying for visitor visa ? Case in like y her tier 1 visa got rejected and y does she want to apply for visitor visa ...... did you give any surety that she will be back within 2- 3 months ... if no that it was bound to get rejected... bcz my case is same as yours but i have not applied for visitor visa .. will be applying in the month of feb ... my visa got rejected bcz of lack of marriage evidence .

Hi there,

Many thanks for answering my question.

In my wife's application for tourist visa, she mentioned in the covering letter that she intends to come back in 2 months. However, we didn't explain explicitly that why dependent visa was rejected the first time.

The reason for that is we made an informal appeal (on a simple letter) when dependent visa was rejected (as advised by one of the administrative staff member in the visa office in Mumbai). We heard that our appeal is rejected in a week's time. That's why we didn't explain it while applying for tourist visa. In hindsight, I guess that informal appeal didn't even go inside the relevant office for consideration.

This time they have given us the form to appeal against rejection of tourist visa. Do you think we should make an appeal or apply for dependent visa again or anything else?

Go for appeal .... she will get the visa in 5 months ... if you re-apply n then again it may get rejected ... y u wanna take a risk .. i think if your visa gets rejected for the 3rd also you cannot apply for next 10years ...{ check } i am not sure.

Hi,

Best think is sort out your funds and re-apply for dependent visa. Tourist visa is not option but you have 90% chance to get her visa stamped if you fulfill the requirements they questioned earlier. So, no need to go here and there and just stick with main application (tier 1 dependent visa) and re-apply.
