Travel on OPT, H1-B approved, return before october'08

Hi,

I'm working in the US since Apr'08 after my graduation on F1/OPT visa. My H1-b application has been approved , and i have the approval in hand.

Question : can i travel and return to US in august on OPT without H1 stamping.

H1-B Approved Oct'08 - Sep'11
OPT valid till Dec 17, 2008

Wish to travel to India, 30th Jul - 20th August
re-enter on OPT , without getting H1 stamped.

Please let me know if there is any kind of risk involved, i do not plan to get H1b stamped on this trip.

Are u from Hult, Boston???

You should not have problem and you could come in with your OPT as you have 4 months left for your OPT to expire. I know people have travelled out of US and have come back and no questions asked.Make sure to carry your paystub though. If you would already have travelled out of US during your opt, that would act to your advantage.

Don't worry about your H1 that is eff from OCT 1st, as you would be coming on OPT. IF asked at immigration you should explain them that you are working under OPT and some proof. Good luck
