this is my first time here I wish I would be welcomed by everyone of you.

well, I'm in big trouble due living without status in the Uk.let me tell you my story.


right, I came to England in 2001 with visitor visa.In January 2002 I claimed asylum seeker application which was rejected in March 2002. I appealed against it but, unfortunately it was dismissed either in the same year (2002).In December 2002 I met my husband with whom I have been living since then.I got one son from him,both of them are British citizen.I let you know that my home country is Algeria.On 4th January 2008 I got married to my husband under the English law (register office) I'm reporting monthly to the immigration office.I submitted various further applications on the basis of marriage but all were exhausted.On October 2007 I submitted a fresh claim human right application with no reply so far. In June 2008 I received a letter from the HO telling that my case is considered as a legacy case and it has been allocated to the case resolution team who is Liverpool 8.

my questions are:

has my case been considered as a family legacy case or not as I was single when I claimed asylum application?


being from ALGERIA does it affect the legacy case's decision?


could you tell me what are my chances of getting a status.

Did they say why you were turned down...what was the reason?

What does your immagration officer say...is he advising you on what to do?

You say that you have submitted further claims on the basis of your English marriage and yet you have heard nothing.....did you try to contact them to find out why?

Do you have a professional back ground which sometimes can be important?

The fact that you have heard nothing from your last application may be a sign that something is happening, can you speak to your immagration officer and see if he can help you, being that he is in possesion of all the facts.

Judging by your post ...yes your case does appear to be considered as a legacy case by the H.O, the fact that you've had a letter just says that your case has been allocated to a case worker, infact it could take up to five years to resolve, within that time you could be granted permission to reside in the uk but they do not promise.

A lot will depend on your individual circumstances, the fact that you are married and have a child is in your favour, if you work as a professional here that will also help.

If you can try to get yourself some reliable, proffessional help,rather than be at home sick with worry, it will lay your mind at rest.

I know Solicitors can be costly, unless you are on a low income in which case you should qualify for legal aid, if this isn't an option there will be a,... Citizens Advice bureau...some where local to you, there are lots around, they will know everything there is to know, legally or otherwise, make an appointment write all your story down so's you don't miss anything out and go along and see them, what they don't know they will do their best to find out for you, they are lovely people so don't worry.
