Filing taxes for a nonresident spouse

Hi, I'm a citizen who filed taxes together with a noncitizen spouse. My husbands visa is expired we spouse for ITIN with a copy of a foreign passport, got a letter from IRS requesting a notarized passport and VALID USA VISA, but his visa is expired, so what do we do now? We are in prosses for his petion, but it will take a long time for his visa or green card. Should we refile with passport only? or should I file by my self?
