marriage visa taking to long

hi I've been in the uk since 09/2002. i came in on a student visa, and now doing my acca to finish this year. Before my student visa expired in 11/2006, my partnerand i applied for for a living with a partner visa 'cause we had fallen pregnant. this was refused due to that fact although we had known each other for more two years we had been living together only 1.5 years.

before our child was born it was discovered she had cancer, so due to this special circumstance i could stay and apply for a certificate of approval, which i did, and received. We got married in 11/2007,and applied for a leave to remain soon after. Its been 4 months since we applied, and nothing has come back yet. my wife is struggling by herself with bills since i cannot work. i called the home office,but was rudely spoken to, told i was towait, till whenever the application is processd. i have to watch my wife, who is british,struggle alone since I'm hopeless... while the home office cannot even tell me howmuch longer it willtake. Its already over the 14 weeks they saied it would take. what are my rightsand waht should I do in this situation?
