Can my fiancee become a legal US resident?

My fiancee and i have been together for 2 years and we have a baby girl together. He went back to mexico because a family member of his passed. He came back ilegaly again but not before getting caught by border patrol a few times. Both our daughter and me are U.S. citizens. I understand that before i can petition for his residency we have to get married. Would he be able to become a legal resident?
