Salary Employees

i currently have 2 nurse practitioners who are on salary and accepted position under the condition that they only work 4 days for 10 hours a day, now they are wanting an hour for lunch and if they take that hour for lunch then they are only working 9 hours a day resulting in 36 hours a week instead of 40 hours. I tried explaining that if they want that hour (1) for lunch then they need to be here for 11 hours instead of 10 hours, is there any documentation to produce reflecting this requirement or is it based on our personnel policy?

Are you saying that they work 10 hours without a lunch break?

There is no federal mandatory lunch break. You can specify the hours worked and require any linch breaks to be unpaid. However, short breaks like a coffee break are considered part of the paid day. U.S. Department of Labor - Find It By Topic - Work Hours - Breaks and Meal Periods Check your states laws since the feds can be over ridden by state law.

This really is a state labor issue. Federal laws, as ballengerb1 states, do not mandate a lunch period. Period.
