Can a 1099 receive Vacation Benefits

If an employee moves from a W2 to 1099, Are they entitled to cash out on their remaining vacation benefits?

If they move to a 1099 status they are no longer an employee, what is the company rules and regs on paying out vaction benefits to those that leave employment for other reasons.
