    Disability and COBRA subsidy
I was disabled in the early Fall of 2008, and I elected to carry COBRA coverage. The premiums for my wife and I pay are horrendously expensive .

My question is, do I qualify for the new stimulus plan's COBRA subsidy? This would save us hundreds of dollars a month. Any information is appreciated!

I am not sure the plans and details are even available yet. But I don't see it going back, it was intended for those that lose their jobs due to the economy, lay offs.

If your wife is in good health have you priced personal insurance, often it is much cheaper

Family and Medical Leave Act (FMLA)

A COBRA qualifying event may occur when an employer's obligation to provide health insurance benefits ends under FMLA, such as when an employee on FMLA leave decides not to return to work.

The American Recovery and Reinvestment Act contains a provision for COBRA eligibles. The subsidy (Assistance Eligible Individual) allows for a subsidy of 65% to those individuals who qualify.

The qualification criteria is: where you involuntarily terminated between 9/1/08 - 12/31/08.

The definition of an involutary termination is: one who was terminated by their employer due to lay-offs, poor job performance and other types. Gross misconduct is an exception.

You didn't provide a lot of information here about your current situation. I might be able to assist further if you can advise if you are on workers comp, if your disability is due to an accident or if you are in your waiting period for Social Security Disability.

I am not attorney and none of the above is legal advice.
