I tried to post this earlier but I don't think it made it......

How do I get an avatar uplloaded? The option in edit photo doesn't come up and when I go around to find it another way the radio button "do not use photo" is checked and I can't uncheck it?

What am I doing wrong?

You are not doing anything wrong. You have to have a certain number of posts and be a member for a specific period of time before this option is available to you.
