Adultery laws are still on the books in many states, but its unlikely you will get a prosecutor to prosecute.

You may be able to sue for alienation of affection as part of a divorce action.

You are wasting your time and probably money. File for divorce and move on. Pursuing the 'payback' is ultimately petty, childish and probably futile.

artlady agrees: Dig that
Jake2008 agrees: Agreed, move on.

As of 01/2008, the states that allow alienation of affection lawsuits are: Hawaii, Illinois, Mississippi, New Mexico, North Carolina, South Dakota, and Utah.

Even you're in one of these states, the problem is very few attorneys would want to take the case. Don't waste your time and money... divorce and move on.
