    What do I do to get my kids out of Foster care.
    [B]Hi, My name is Melinda and my 2 kids were taken from me by CPS.:( My kids had told there teachers some lies about something's that had never happened to them by me or my boyfriend. I don't know what to do to prove that I never abused my kids. I Love my kids and I would never do anything to harm them at all. :(:(:(:(:(

    You need to get in touch with CPS and talk to them. They are the ones who will decide if it's safe to allow your children to come back to you.

    However, I find it strange that your children would make up lies to tell a teacher for no reason. You may have to face the possibility that your boyfriend is doing things you don't know about. I take it he is not the father of your children? He's an unrelated man you have living in the same house as your two young children?

    Were the children taken permanently or temporarily? In a case of temporary removal, a parent will be placed on "probation"(for lack of a better term) in which the children are living with relatives or foster families, while the biological parent gets their life together and abides by the court's terms in order to prove that they're fit.

    Wasn't there a hearing in which your rights and obligations were explained?

    What exactly did the children accuse you of? How did they know to make false allegations? How old are the children?

    My boyfriend has not hurt my kids because I am always will my kids. I have talked to my CPS worker and I have court on Monday morning. He is not the birth father for my son or my daughter. But the kids treat him like they would there own dad. If my son new his dad and if my daughter was able to see hers.

    I asked you five questions, you answered one of them. We can't advise you if we don't know what's going on.

    The court is not going to care if the children treat your boyfriend "like their own dad." The court cares about whether the children are being mistreated.

    If the kids treat him like their own dad, then why did they complain to a teacher? It sounds like you are in denial. Something spurred the children to talk to the teacher. CPS stepped in and found the complaint credible enough to remove the children to a foster home.

    So what was the specific complaint? As This noted, you need to answer ALL our questions if you want us to be able to help.

    I'm sorry I didn't answer all your questions.The kids were only taken temporarily. The kids are in foster care with a non-family member. I will find out what my rights and obligations are on Monday morning when we go to court. My son is 5 years old and he told his preschool teacher that I hit him with a blue hammer on his bottom and spanked him on his bottom with an open hand. My 6 1/2 year old daughter said I threw a pill bottle at her fore head and she had a bruise on her fore head. But I never threw a pill bottle at her and I never would do that to her or my son. The kids fight all the time like brothers and sisters do. She also had a bruise on her nose from last week when we were outside playing ball as a family and the ball hit her on the nose. My daughter lived with her dad for awhile and he taught her how to lie. She was abused while she lived with him and his girlfriend who had abused her and the girlfriends 3 boys had abused her also.

    You are going to have a problem here. First your son's statement seems awfully detailed for a 5 yr old's lie. Second your daughter's story may be supported by the bruising.

    I think you will not get the kids back until the children have seen a psychologist who can judge the veracity of their story.
