I want to terminate my ex's paternal rights, What do I do?

My daughter is three years old and my ex has never been a part of her life. He has actually made the decision to become a woman and I do not want him anywhere near her. How do I go about terminating his rights so that my fiancee can adopt her once we are married???

First, you wait until you are married, then you find a Family Law attorney to prepare the adoption papers. The attorney will advise you on how to terminate the father's righrs. If the father agrees, its just a matter of signing the relinquishment and submitted it as part of the adoption.

If he doesn't agree, you will have to petition the courts for TPR. Given the sex change, this probably would be granted.

you know scott I may have to disagee alittle,

First I agree that they will need to be married in some states, or in other states prove and show a long term relationship ** since adoption by same sex couples is allowed in many states where they can not be married

But the easiest will be to have the father sign over his rights to allow you to adopt.

Now with so much push on rights and protection against discrimination, I am not sure the issue of the sex change may be a issues, you may want to talk to your attoreny who knows the judge and court better.
