Get the courts permission for a move. Once the decision is made by the courts then follow that.

Hello m:

If he has visitation, then there's a court order in effect. You need to get that order changed.

If you have full custody and his visitation order doesn't state anything to the contrary, then yes, you can move.

ScottGem disagrees: If there is a visitation order from a court, then she can't move if it would affect the exercising of that order.

As excon said, as long as there is a court order giving him visitation, then you have to get that changed before you can move.

The good news is that will probably be a slam dunk. All you need to prove is that he has made no move to exercise his visitation rights and I am confident a court will approve.
