| USMC dad looking for children after wife left state with boyfriend I am a US Marine whose residency is in OK, but am currently in CA receiving specialized training. My wife and both sets of our parents also live in OK. While in boot camp this summer, my wife had an affair and refused to work things out with me when I came home at the end of the summer (we had been separated 5 months prior to me leaving but agreed to try and work things out once I was stationed). Because I am unable to see my children at this time, my parents get the boys each weekend. My parents had arranged w/ my wife a week ahead of time to take the boys out of town this w/e so that my side of the family to meet my newborn (my children are 21 mos & 1 mo). However when they tried calling her a couple of days before the trip, they could not reach her. Her & her mom both refused to answer the phone or return our calls. My wife has started texting my a little and from what I get, she has taken them out of state with her boyfriend (we have heard rumors for a couple of weeks that she was planning on moving to another state with him). She refuses to tell me where she is at or when (or if) she plans on returning home. I called the local sheriff's dept. to see what they could find out and her family lied and said she would be home later that evening. I don't know for sure which state they are in or when (if) they will return. I don't know what my rights are since I am in the military. She is unemployed, not motivated to better herself, the boys are always dirty and not taken care of. She is not abusive, maybe a little neglectful. I know she loves them, but I also know that I am the better parent for them. I can live independently. She either lives rent free in one of my parent's rental homes or (here recently) with her mom, and now is obviously living with her boyfriend. The boys are being bounced around and have no income and no stability. I would like to file for divorce based on abandonment and try for sole custody with my parents listed as their guardians until I am out of training and can take the children. Do I have a chance as a military father? Could this be considered kidnapping? |
