    Texas child abandonment laws
    I live in Texas and I have a 14 year old who has never met his bio-father. The bio has not paid CS for a year in June 2010. He has never provided medical and is over 10,000 in arrears of CS. He pays when they catch him and take it out of his paycheck then disapears again and doesn't pay. My son is 1 of 8 children to this man and I know of 3 more he has nothing to do with. The attorney general wants to take him to court this summer and press charges for failure to follow a court order. 10 years defered adjudication. My husband has raised my son as his own and is the only dad my son has ever known. My husband has supported and provided for my son 10 of the 14 years of his life. The bio hasn't even so much as called to see if my son is even still alive. My husband would like to adopt my son. How do I get the bio-fathers rights terminated?

    You start by getting a lawyer and then go to court over the adoption. You need to find the bio dad and ask if he is willing to participate. That way it can go smoother. If not then you will have to justify to the courts why it should be done.

    Yes, attorney has to be the first stop, and if bio father will just sign his rights over, no problem, if not you will have to prove to the court that this is in the best interest of the child and that it meets your states requirements for taking away his rights
