Taking away rights from my ex

I hope that this the appropriate forum. I am having a moral dilema. My husband and I are going through a divorce but have been separated since just after I concieved my son. He is now 5 months old. My husband came just after our son was born but, spent the rent money to do so. I have documents showing my husband's addiction to spending money which has hurt me in many ways. He is in the military and is getting housing allowance but not sending it or paying for medical bills for our child. I am thinking about petitioning for my husband to loose his rights to the baby through our divorce. I don't know if they'll take my evidence as reason enough or what it would involve if I can have his rights removed. Any help would be much appreciated. Thanks.

The father isn't a bad guy, he just is a kid who likes kid things and doesn't understand responsibility. He can't manage his money and parties hard all the time. He is in the military and is very far away, soon in Iraq. I want to give my current partner the opportunity to adopt once we are married. The person I am with now saw me through all of my pregnancy and helped as my husband threw me further into debt and made me lose my car, nearly get evicted etc. He can't care for a child, if he weren't in the military, he'd be incapable of caring for himself let alone my baby. I have documents showing addictions to adult oriented online sites (addiction meaning hours spent online daily and multiple paid subscriptions), he spends his money on these things along with whatever else he desires and keeps government issued money that was supposed to go toward caring for myself and the baby. I don't want that influence in the baby's life.

Simply put you can't have his rights removed. What you need to do is go to court for your divorce at that time the judge will order child support and visitation for the father to see the baby. This way you will get the child support and if it isn't paid you can go back to court to have it enforced he will first get a warning then more serious actions will be taken. However, no judge will grant a TPR for this case.
