Taking away parental rights

I know every situation is differant and mine goes as follows. My sons father broke into my house and beat and raped me in front of our son in 2005, he is now in prison until 2010. To make a long story short i want his rights taken away, i dont ever want to see or have anything to do with him again. Before this inncodent happened he only saw his son maybe twice within a year, after it happened court took place two years later on Nov 2007because he went awall and was no where to be found. He did not see my son for those two years and i only received one child support payment. I was wondering if its possable to take his rights away?

I think it depends on the state, and what the laws are there. But I believe you can if you can prove him an unfit father, which doesn't sound like much of a task. So please let us know what state you reside in, and we can look up info for you.

I live in Minnesota. Im currently deciding if I should consult in a lawyer, but thought I would try this first to get others opinions and maybe someone else has had a similar situation. Thank you for your help!
