My name is Angela I have 3 kids. My oldest daughters father has not had anything todo with her since Mothers day 2006. He has not called he or even paid child support for her in over a year. My husband Russell is wanting to adopte her and that is what she wants. I have explained to her what that means and that is what she want. Talk to an attorney. Each state has different things you have to do.

It might be as simple as putting an ad in local papers trying to find the father or announcing the adoption so many times, then if there is no response the Judge should assign the rights to your husband.

Most courts regardless will still go thought the process of contacting the bio father to inform him and get his permission, But no matter what, an attorney will be needed.

You will need to contact an attorney and see what the specific laws are where you live.

In Ohio, it is a minimum of 6 months with no contact AND no child support...then you can file abandonment and petition to have his rights terminated so your husband can adopt.

Also on another subject - I am not certain that a 6 year old child should be privy to adult problems, no matter how smart she is.
