    Signed birth certificate, not father, what are my rights
    I signed the birth certificate thinking I was the dad, found out 3 years I was not due to dna test , but was still in picture as the dad, the kids are 5 now, and she won't let me see them unless I give her money. What are my rights to the children in the state of Georgia?

    Were you married, are you divorced, is there a separation agreement?

    We were never married, and there's not paper work saying that I have to pay. She took me to child serves to try and get more money than I was giving her and they did the dna test, but nothing was said after that. I was giving her cash but I don't think it's going to the kids, so I said I would directly take the money I was giving her and pay clothes or whatever was need for the kids, and that's were the problem came in.

    Tough situation for you, if DNA tests prove you are not the dad then you likely have no rights to exercise.

    Well it depends on whether you just signed the birth certificate or an acknowledgement of paternity

    If you are still listed on the birth certificate, until she goes to court to remove you as the father, due to DNA tests you are.

    But you have no "right" to see the child, you have a "right" to go to court and get a child visit order. And she has the right to go to court and get child support.

    Also if she is going to collect any welfare in GA, they will come after you for repayment as the listed father.

    So you can risk taking her to court , where she can get court ordered child support ( in GA about 20 to 25 percent of your gross pay) plus possible payment for insurance, and day care.

    When paying support, you can not tell her where the money goes to, the child living in an apartment rented, is using child support, eating food mom buys is using child support, and so on

    He cannot "just sign"BC without signing a Paternity Acknowledgment

    In Georgia you may add your name on BC only if you sign PA.
