    He hasn't ever been in her life and isn't on the birth certificate.

    You can try but you won't get very far without it... the baby wasn't the result of an immaculate conception. And the court is going to be asking for that.

    Does not matter if the bio father is not on the birth certificate,

    You will have to attempt to locate him and have him sign his rights over to allow the adoption.

    Even if he is not on the birth certificate it does not mean he does not have rights.

    Normally if they have no contact but are being faced to pay child support they are normally glad to sign so they don't have to pay.
