In NY it is "basically" by statute, based on income. The Courts take the position that the child from the first relationship shouldn't have to suffer because there is a child in a second relationship.
I'm sure you realize the first child still needs to eat, have heat and electric, have shoes ... despite the second child. This is a very difficult situation on all sides - mother, father, second wife who would like to have a child and I do understand that.
$700 a month translates to a little over $162 a week. It used to be 18% for one child so that's on an income of $46,000/year, give or take. |
