Someone has asked me what he can do about his situation and I have no clue.
His situation is kind of complicated and he does not know what to do/whom to contact.
He is ukrainian, and in january 2003 moved to The Netherlands where he oficially married a dutch citizen. In april 2005 they moved to Prague, Czech Republic.
Now his spouse tries to divorce him under the Czech law, different from the dutch what means that he'd lose his main rights for maintenance. He says he was taking care of their house, home, garden, dog etc. while his spouse was working. He cannot work there cause his permission to stay there is based on his spouse's job. Consequently he has no means to get a lawyer. His spouse has now a new "partner" who lives with them since 8 months without his permission and he feels totally humiliated there with his things being taken without his permission or even stolen, abusing him all the time and trying to get rid of him etc.. He says he has the right to make prolongate his permission in Czech Republic but his spouse doesn't want to cooperate cause he wants to divorce him while he'll already be in Ukraine.
He is asking for legal way to support his rights as a NON-EU citizen gay-spouse, married with a dutch citizen in The Netherlands and living in Czech Republic.
He will really apreciate any advise!
Thanks!
