My ex purgered while we were in front of the court commissioner. Not one time, but three times, then right after we left the court commissioner's office, we met with the Judge and he lied yet again (that is his life). Can I request my lawyer to ask the commissioner to charge him with purgery? All I know, is when you are in front of a Judge, under oath, you can be charged for purgery, but infront of a court commissioner, is that the same even though, technically, you are not sworn in?

You can only be charged with perjury if you lie under oath. Only a prosecutor can decide to prosecute.

Your attorney, however, should be cross examining to show that perjury was committed.

My attorney re-mentioned the truth back to the commissioner, i.e. "remember Commissioner ______ before he said this." So, I guess, for the Commissioner side of things, we'll just let him (my ex) continue to make a fool out of himself then.
