owed $5,000 in child support, father still on the streets

I live in SC and my sons father was just ruled in for bein over $5,000 behind. He paid half of his actual payments 3 weeks in a row before his court date. They have not locked him up or anything. This is a pattern for him because everytime they rule him in he makes partial payments and after the hearing he doesn't pay. There is a woman in the DSS office that has been advising him of how to work the system. I need to know what I need to do because we have a child support reduction hearing this Tuesday and he's still over $5,000 behind.

It is not in anyone's interest for him to be locked up, as he cannot earn money from jail. In California, a father who did not pay child support would have the county take the child support from his paycheck and pay it to you. Ask DSS if you can arrange for that.

You need to find someone in DSS who will advise YOU, preferably not the same person who is helping him, if you think she is biased.

Regarding the child support reduction, it should only be reduced if there is a change in circumstance. The child's interests always come first. Do you have anyone advising you?

Hello e:

What do you need to do something about? You're going to a hearing. You'll tell the judge that he's behind. The judge will tell him to pay. He'll tell the judge that he's paying too much. The judge will decide if it's true.

You apparently already know how to "rule him in", and get paid something.

In your other post you said the the bio dad wasn't there to sign the birth certificate, now you are saying that you are owed support. Do you have two different children or is this the same man that wasn't there to sign the birth certificate so the court did a DNA test to prove him to be the father? As for the child support you show up at the hearing and see what the judge has to say. As pointed out it isn't in anyones best interest if he is in jail. If this is the same child as in your other post and you are wanting you husband to adopt how long have you been married? Most states require a year before the spouce would qualify then you can just ask the bio dad if he will allow the adoption and if he will get a lawyer to draw up the papers and it will go smoothly. You can tell the bio dad the he will no longer owe support if he allows the adoption that sometimes helps sway them.
