| NY Law: Paternity on Deceased Parent Hello,
I am trying to have the DNA of a deceased person tested for paternity in Nassua County, NY. The Medical Examiner confirmed that they have his blood and tissue stored and there is enough to test.
This is a man I did not know. He did not know me. My mother told me he is my father and that he too believed he was my father. But my mother married someone else and they raised me. My mom did not tell me about him until after he was dead. I would like to test the DNA to see if he is really my biologicial father.
I am no longer a minor - but I need to test for medical reasons.
How can I get a court order to test the deceased? Thre ME's office said I should be able to get a court order because nobody will try to block or contest it. HIs next of kin (wife) was remarried several years ago and moved away. We cannot find her, nor do we know her new married name.
